Adoption Process
Any person or couple who are unable to have children of their own will never underestimate the importance of adoption; the question of suitability is probably the first issue to be dealt with. Adoption law in America is complicated and legal requirements are different in each state in addition to Federal laws to overcome. this is an area not to be underestimated, because without the compliance of both, it will not proceed. It is not surprising that large numbers of potential parents are discouraged by this complexity and never actually apply; just a few facts and ground rules can make all the difference when planning an application.
The definition of is long but in brief, it is where the legal responsibility for a child is transferred to a person or couple who are not the birth parents; the child in many circumstances is an orphan. It is important to understand this is more than just a person or couple looking after a child because they will take complete moral and legal responsibility for them; this also means the adoptive child is granted the legal rights of a natural family member. These rights include the rights of inheritance, whether this is shared with natural offspring or not.
In the adoption process, before it is finalized, all parties (including the natural parents where possible), must be identified; this is done, in part, to assure that it is fair and lawful, and capable of withstanding any external conflicts. The difficulty of determining biological parentage varies, depending on state law, and other surrounding circumstances; there are occasions where a child may be a ward of the court or their parents have died. The Adoption of an infant is sometimes because the mother is not an adult and when this occurs, it is not unusual for her parental rights to the child to be terminated; usually at the same time as the adoption process to be completed.
One Federal law that must be followed is the home study which must be completed by any person or couple who has decided to adopt with the United States; the government has made this a part of the application that must be adhered too. The purpose of the home study is to provide proof that the adopted child will grow up in a clean, well balanced environment that is safe and secure. In a home study, a children's social worker will conduct a criminal background check; the medical history is also reviewed and an inspection of where the child will live.
If the home study does not show anything detrimental about the potential parents then the request will be approved; they will still have to wait a while for it to actually take place however. Before the process is complete the family judge must carefully consider all the information regarding the child, their real parents and the adoptive parents. Legislation is under continual review and any person considering adoption needs to be aware of this; in these circumstances it is worthwhile to keep informed of new laws and to know what is expected of an applicant in the state where you live.
